CLEANING

1. Definitions

“Business ” or “We” means Old Skala Villa Management
“Cleaner”means the person or firm carrying out cleaning services on behalf of the Business.
“Handover Visit”means a visit to Your property by the Cleaner as a consequence of a change of guests and/or one-off cleaning requests made by You.
“Cleaning Visit” means a visit to Your property by the Cleaner in line with the agreed cleaning schedule.
“Service”means the cleaning services carried out on behalf of the Business.
“Us”means the Business and You together
“You” or “Your” means the person, firm or corporate body together with any subsidiary or associated company as defined by the Companies Act 1985 to whom the cleaning services are supplied by the Business.

2. Contract

2.1 These Terms and Conditions represent a contract between the Business and You.

2,2 You agree that any use of the Business ’s services, including placing an order for services by telephone, email or website forms shall constitute Your acceptance of these Terms and Conditions.

2.3 Unless otherwise agreed in writing these Terms and Conditions shall prevail over any other terms of business or purchase conditions put forward by You.

2.4 No variation or alteration of these Terms and Conditions shall be valid unless approved in writing by an authorised person of the Business.

3. Quotation

3.1 The Business will always visit Your property prior to providing a quotation for the Services.

3.2 The Business will base its initial quotation on;

3.2.1 The size of the property,

3.2.2 The size of individual rooms,

3.2.3 The expected amount of laundry,

3.2.4 The condition of the property, and

3.2.5 Estimates of how long it will take the Cleaners to complete a Cleaning Visit

3.3 You accept that it is difficult to calculate precisely how long such tasks take and that a degree of flexibility may be required.

3.4 Handover Visits take longer to complete due to the intensity of the cleaning required and/or due to longer intervals between Cleaning Visits (and number and type of cleaning tasks required) when compared to the regular cleaning of the same property.

3.5 All quotations offered by us are deemed valid for a period of 30 (Thirty) days, after which we reserve the right to revise the said quotation.

3.6 The Business reserves the right to amend the quotation, if in the opinion of the Business Your original requirements change significantly.

4. Deposit

4.1 You will pay Us a deposit of €500 (“Deposit”) or such amount as agreed by Us which will be used by against late payments due under clause 4.5.

4.2 The Deposit will be returned to You on termination of the Services as instructed by You under clause (net of any outstanding payments and, if relevant, interest due on the date of termination).

5. Fees

5.1 All work carried out by the Business, whether experimental or otherwise, will be charged according to the agreed quotation and schedule.

5.2 Any work undertaken by the Business on Your behalf will be carried out on the basis that You have approved such work providing there is evidence of written or verbal confirmation to proceed, including letter, facsimile or email correspondence between Us.

5.3 Payments of fees will be against invoices issued by Us and are due within 14 days unless otherwise agreed by the Business in writing.

5.4 We shall invoice monthly.

5.5 Where payment has not been received when due, We will use the Deposit to cover the overdue account until payment is received and, it payments are in Our opinion excessively overdue, reserve the right to charge interest at a rate of 5% per month or part thereof.

5.6 If You exhaust the Deposit we reserve the right to withhold the Services with immediate effect.

5.7 Handover Visits will be charged at a 50% premium to regular Cleaning Visits.

5.8 Unless otherwise expressly stated, all prices shall be in Pounds Sterling and shall be exclusive of VAT and other duties.

5.9 VAT and other duties will added if required by law.

5.10 Any additional work requested by You that isn’t covered in the original quotation will be quoted separately and added to the monthly invoices.

5.11 All Service prices are reviewed annually but You will be given at least one month’s notice of any change.

6. Term

6.1 The minimum contract term is 12 months (“Initial Term”).

7. Equipment

7.1 Cleaning materials are provided by the Business.

7.2 If you require us to use your solutions or equipment they must be safe to use/operate, in full working order.

7.3 If You require the Cleaner to use Your own materials and equipment the Business cannot accept any liability should anything go wrong with either the equipment or the outcome of using it.

8. Checklists

8.1 On request, We shall provide You with a checklist or ask that You leave a list of priorities for the Cleaner.

8.2 We will provide a monthly report on any repairs or replacements of which We believe You should be aware – it is Our experience that dealing with repairs promptly is ultimately cheaper for You.

9. Refunds

9.1 No refunds will be given once the Services have been carried out.

9.2 If for any reason You are dissatisfied with any aspect of the Services, You must notify Us within 24 hours.

10. Cleaning Visit

10.1 You agree to pay the full price of a Cleaning Visit, if:

10.1.1 You cancel or change the date/time of a Cleaning Visit less than 24 hours prior to the scheduled appointment;

10.1.2You fail to provide access to the premises thus preventing the Business to carry out a Cleaning Visit;

10.1.3 There is a problem with Your keys and the Cleaner cannot gain entry to the property. If keys are provided they must open all locks without any special efforts or skills.

10.2 If You need to change the date or time of a Cleaning Visit We will do Our best to accommodate You as long as We are given 24-hour’s notice.

10.3 Please note that the Business cannot guarantee that the same Cleaner will be available on the new day and at the time You require.

10.4 Any changes in the cleaning schedule are subject to availability.

10.5 Our  Cleaners work on any day of the week including Bank Holidays; You may have to consider this when seeking to provide 24-hour’s notice of any change to a Cleaning Visit.

11. Cancellation

11.1 You may terminate this contract by giving 30 days prior notice in writing following the Initial Term.

11.2 If You wish to terminate the contract within the Initial Term, We may require You to pay the outstanding balance for the remainder of the Initial Term.

11.3 We will provide You at least one month’s notice if We decide to discontinue the Services.

11.4 We reserve the right to discontinue the Services with immediate effect if You have exhausted the Deposit.

12. Liability

12.1 The Business shall not be liable under any circumstances for any loss, expense, damage, delay , costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by You arising from or in any way connected with a late arrival of Cleaners at the service address.

12.2 The Business endeavours to be on time but sometimes due to transport and other problems which are beyond the control of the Business, the Cleaner may arrive with a delay or the Cleaning Visit may have be re-scheduled.

12.3 The Business shall not be liable under any circumstances for any loss, expense, damage, delay , costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by You arising from or in any way connected with;

12.3.1 the lack of hot water or electricity,

12.3.2 a third party entering or present at Your premises during the cleaning process,

12.3.3 any existing damage to Your property in the form of old stains/burns/spillages etc. which cannot be cleaned/removed completely by the cleaning operative,

12.3.4 any damages worth £100 or less.

12.4 Whilst the Cleaners make every effort not to break items, accidents do happen. Identical replacement is always attempted but not guaranteed. For this specific reason, the Business requests all irreplaceable items (whether monetarily or sentimentally valuable) be stored away and /or not cleaned by the Cleaners.

12.5 In case of damage, the Business will repair the item at its own cost. If the item cannot be repaired the Business will rectify the problem by crediting the customer with the item’s present actual cash value toward a like replacement.

12.6 The Business shall not be responsible for damage due to faulty and/or improper installation of any item. All surfaces (i.e., marble, granite, etc.) are assumed sealed and ready to clean without causing harm.

12.7 Key replacement/locksmith fees are paid only if keys are lost by our Cleaners.

13. Complaints

13.1 All complaints are taken seriously. If you are not happy with any aspect of the Services please call us as soon as possible and give us the chance to rectify it. Your custom is very important to us and we want you to be happy.

13.2 If You are dissatisfied, We ask that You notify us as soon as You notice anything that might be to Your dislike by calling directly.

14. Supplementary Terms

14.1 If You request keys to be collected by the Cleaners from a third-party address then a £5.00 charge will apply. If the keys need to be returned to the third party or any other address, an additional charge of £5.00 will apply.

14.2 We shall endeavour to arrange a replacement Cleaner if Your regular Cleaner cannot attend a Cleaning Visit. 

14.3 The Cleaners are not allowed to hand-wash any items. We send all laundry to Our approved service providers.

14.4 All fragile and/or valuable items must be secured or removed.

14.5 We reserve the right to make reasonable changes to the Terms and Conditions in agreement with You.

15. Our Guarantee

15.1 We have built our business and reputation by providing Our clients with the best possible service. Still, We realise that because Our Cleaners are human beings, they sometimes make mistakes. For this reason, We offer a Guarantee. If You are not satisfied with any areas that have been cleaned, the Cleaners will return to the property and re-clean those areas free of charge.

16. Law

16.1 This contract is subject to the laws of England and Wales.
